"Private" Beaches in Cancun

In Mexico, there are no private beaches. All are public by federal law (Art. 27 of the Constitution). This guide explains which hotels have exclusive beachfront and how to access any beach.

Under Article 27 of the Mexican Constitution and Article 8 of the General Law of National Assets, ALL beaches in Mexico are for public use. No hotel can deny beach access. Fines for blocking public access can reach up to $1,000,000 MXN. Public access points are marked with blue and white Fonatur signs along Boulevard Kukulcan.

How to Access Any Beach

  • 🔵 Look for the blue and white Fonatur signs along Boulevard Kukulcan. These are the official public beach access markers.
  • 📍 There are over 20 marked public access points throughout the entire Hotel Zone of Cancun.
  • ⚖️ Hotels MUST maintain an open path to the beach. No hotel can block the legally established access points.
  • 📞 If you are denied access, you can file a complaint with Profepa (800-776-3372) or Semarnat. Fines can reach up to $1,000,000 MXN.
  • 🏖️ The best public beaches with free amenities: Delfines, Marlin, Tortugas, Las Perlas (parking, restrooms, lifeguards).
